The right to contract or covenant has been one of the most basic and inviolable freedoms in any truly civilized nation.
With it you can barter away every other freedom and right, for it is your basic and sovereign right to accept or renounce your freedoms.
Military service is one example of this right in action, and one that is most often abused by renegade governments (individuals posing as representatives of governments), seeking to impose lawless abuses and tyrannical, dictatorial controls.
Mandatory Military Service?
Military service, far from being mandatory, is an act of voluntarily relinquishing, for a set and determined time, your rights and freedom of choice.
To believe this choice can be forced upon anyone is equivalent to believing you can be forced to sign any other contract regardless of its onerous or detrimental terms!
Rather, serving in the military is a matter of free will, or whether you choose to obey orders rather than exert your free will to choose to do otherwise.
No government agent, representative, judge or otherwise, has any right or power to interfere with this most basic of all human rights and freedoms.
Militarized Police!
That some usurp powers not delegated to them goes without saying, for there are always those who seek to impose their will upon and over others, even their superiors!
The public is superior to the military, whose only true duty and task is to protect the lives, property and freedoms of the public -- their superiors -- from any invading force or enemy, foreign or domestic.
When the military becomes a police power, or the police are weaponized and become militaristic in their conduct, treating the public like enemies without proof, trial or evidence, they are the very sort of domestic enemies the military is supposed to defend the public against!
These are like the contradiction in terms that is so prevalent as to be almost ubiquitous: the proverbial unjust judge.
Injustice In The Courts
How can a judge be unjust, when justice is the only duty of a judge to begin with?
A judge that violates or ignores the law with their rulings is only giving their personal opinions, and not actual legal opinions that are binding upon anyone.
Higher courts have a duty to overrule such arbitrary and unjust decisions, but the fact that so many refuse to do so is one of the reasons such unjust judges continue to exist, and even thrive, within courts that for the most part are utterly devoid of public oversight.
This is because the press has been remiss in their most sacred duty and trust of reporting on these abuses, raising public awareness and sounding the alarm against such tyrannies as daily transpire in such lawless courts.
Superior Jurisdictions?
Arbitration is the right to contractually opt out of any jurisdiction, waiving any rights that might otherwise be inferred, imposed or defended, in favor of a mutually agreed upon arbiter to decide matters in relation to the contract or covenant entered into freely between the parties.
Adherents to a religious faith, for instance, can mutually agree -- as part of their faith and social contract as congregants -- to be bound by decisions of their ministry, even if these might otherwise be considered violations of basic rights or freedoms.
Such contracts need not be overt, such as signing a document, but are evident by voluntarily association, or by acquiescing to the will of those who are the leaders or decision makers, thereby giving your tacit consent to their authority.
Once authority is thus assigned and assumed, you bind yourself to its decisions as surely as you bind yourself to a political ideal, patriotic notion or any other form of social contract.
Therein lies the danger, if you are not careful in setting certain boundaries or limits upon the supposed authority of those you entrust with the duties of leadership!
Pursuing Happiness
There are Laws that should and do by right override any and all human laws, which neither you nor anyone else has any right to transgress, ignore or renounce.
Life, liberty and the pursuit of happiness are chief among these fundamental Creator-granted rights you must hold to be self-evident for one and all, lest you suffer their loss personally.
The pursuit of happiness includes the right to own, possess and enjoy the use of property within the context of this higher Law.
Bogus Supposed "Rights"
Some supposed human “rights” or “freedoms” many believe in today are nothing of the kind, because they impose penalties or judgments upon not just the perpetrators but the entire public, as permitting or allowing such evils to exist.
These include anything that violates the sanctity of legitimate marriage, whether it be pornography, prostitution, adultery, birth "control," abortion, or homosexuality, any greed-based vice such as gambling, excessive drinking and mind-altering drugs that impede or destroy responsible control over one’s own conduct and behavior, holding a government office to enrich oneself while gaining unjust authority and power over others, or misbehaving and routinely lying and falsifying facts as a member of the press.
Included are other self-destructive activities, such as dietary or addictive choices, including tobacco use, which impose excessive costs for healthcare and treatment upon others, along with the burden of attempting to care for those debilitated by their careless, heedless and otherwise unwise choices, or secondarily, who don't choose to abuse and misuse but are adversely affected by those who do.
The Vital Assumption
Arbitration is not binding where it attempts to subvert or nullify basic human rights, such as the dignity of life without suffering or intervention, without just or sufficient cause.
In a world in which terrorists are called patriots, and patriots attempting to defend their lives, liberties and freedom against involuntary servitude to any human devised and imposed tyranny are labeled terrorists, there can be no assumption that such things are allowable under any contractual arrangement, whether arbitrated or not.
Similarly, no human judge other than one’s peers can be safely said to rightly decide matters of conscience or justice, unless they are themselves obedient to that higher Law of our Creator first and foremost.
